These terms apply to all visitors, users and customers of our website. We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of our website following any changes constitutes your acceptance of the updated terms.

3. Products and Pricing

All products displayed on our website are subject to availability. We reserve the right to discontinue any product at any time without notice. All prices displayed on our website are in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change our prices at any time without notice. Price changes will not affect orders that have already been confirmed. While we make every effort to ensure product images and descriptions are accurate minor variations may occur. We reserve the right to substitute products of equal or greater value if a specific item becomes unavailable.

4. Orders

By placing an order with Modern Gift Co you are making an offer to purchase the selected products at the stated price. We reserve the right to accept or decline any order at our discretion. Your order is confirmed when you receive an order confirmation email from us. We are not responsible for orders that are not received due to incorrect contact details provided at checkout. Once an order has been packed and dispatched we are unable to make changes to the order contents or delivery address without incurring additional fees.

5. Payment

We accept payment via the methods displayed at checkout. All payments must be received in full before your order is processed and dispatched. We use secure third party payment processors and do not store your financial information on our servers. If your payment is declined please contact your financial institution or try an alternative payment method.

6. Shipping and Delivery

We ship all orders via Australia Post using standard and express shipping options. Orders are processed and dispatched within 48-72 business hours of payment confirmation. Delivery timeframes are estimates only and are subject to Australia Post's schedule and any delays outside our control including but not limited to extreme weather events, public holidays and peak postal periods. We are not responsible for delays caused by Australia Post or any other third party courier service. We do not deliver to PO Boxes. Same day delivery is available within Sydney only via courier, is subject to availability and incurs an additional fee. Orders must be placed before 11am to qualify for same day delivery. Once your order has been dispatched you will receive a tracking number via email. Risk of loss and title for products passes to you upon delivery.

7. Gift Messages

A printed gift message can be included with your order at no additional cost. A handwritten gift message is available for an additional fee of $5 AUD. Please ensure your gift message is appropriate and does not contain offensive, discriminatory or inappropriate content. We reserve the right to decline to include any message that we deem inappropriate at our sole discretion.

8. Corporate and Bulk Orders

Corporate and bulk orders require a minimum of 20 boxes. A lead time of at least 14 days plus shipping is required for all bulk orders. Corporate orders are subject to separate pricing and terms which will be provided upon enquiry. Please contact us at contact@moderngiftco.com.au to discuss your corporate gifting requirements. Full payment or an agreed deposit is required before production commences on bulk orders.

9. Returns and Refunds

Our Returns and Refunds Policy forms part of these Terms and Conditions. Please refer to our Returns and Refunds Policy page for full details of your rights and our obligations. Nothing in our Returns and Refunds Policy limits your rights under Australian Consumer Law.

10. Intellectual Property

All content on the Modern Gift Co website including but not limited to text, images, logos, graphics, product descriptions and design is the intellectual property of Modern Gift Co and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify or use any content from our website without our prior written permission. Any unauthorised use of our intellectual property may result in legal action.

11. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for full details of how we collect, use and protect your personal information. By using our website and placing an order you consent to the collection and use of your information as outlined in our Privacy Policy.

12. Limitation of Liability

To the fullest extent permitted by Australian law Modern Gift Co will not be liable for any indirect, incidental, special or consequential damages arising from the use of our website or the purchase of our products. Our total liability to you for any claim arising from your use of our website or purchase of our products will not exceed the amount you paid for the relevant order. We do not exclude or limit any liability that cannot be excluded or limited under Australian Consumer Law.
